Terms for the AgentDS Partner Program

1. About these terms

These terms apply to the AgentDS Partner Program. The program is run by UY4X Pty Ltd, ABN 18 702 107 846 (“we”, “us”), which provides AgentDS. “You” means the business approved as a partner.

By applying to the program you agree to these terms. Anything we agree with you in writing on approval forms part of them; if the two differ, the written agreement applies.

2. Applying and approval

You apply using the form on the Partner Program page. We review every application and may approve or decline it. You become a partner only when we confirm your approval in writing, by email.

Keep your details, including your registration details, accurate and tell us if they change.

3. Referring agencies

As a partner you may introduce agencies to AgentDS. A referral counts when the agency signs up using the referral link or code we give you, or when we confirm in writing that you introduced them.

If two partners introduce the same agency, the referral belongs to the partner whose link, code or written confirmation came first.

4. Commission

Commission is paid on the basis agreed with you in writing when you are approved. No commission is payable unless that written agreement exists.

Commission applies only to referred agencies that become paying AgentDS subscribers within the attribution window, and only to amounts they have actually paid and not had refunded.

5. Attribution window

A referral stays attributed to you for 12 months from the date the referred agency first creates its AgentDS account through your referral. After 12 months the referral no longer earns commission unless we agree otherwise in writing.

6. No self-referrals

You may not refer your own business, a related business, or any agency you own, control or work for. These referrals earn no commission.

7. Fair and accurate promotion

Describe AgentDS accurately and only as we describe it on agentds.ai. Do not make misleading claims about AgentDS, its features or its prices, and do not say you act for us or speak on our behalf.

Follow Australian law when you promote AgentDS, including the Australian Consumer Law, the Spam Act 2003 and the Privacy Act 1988. Where student enquiries are passed to you through the program, use them only for the service the student asked about and handle them under the Australian Privacy Principles.

8. Ending the partnership

Either of us may end the partnership at any time by giving 30 days’ notice in writing. Commission earned under the written agreement before the partnership ends remains payable.

We may withhold commission on any referral that breaks these terms, such as a self-referral or a referral won through misleading claims.

9. Changes to these terms

We may update these terms. We will email you at least 30 days before a change takes effect. If you do not agree with the change, you may end the partnership before it takes effect.

10. Governing law

These terms are governed by the laws of New South Wales, Australia. Each of us submits to the courts of New South Wales.
